Terms and Conditions of Sale

Price and Payment

All prices displayed are the total price you will pay. Value Added Tax (VAT), where applicable, and any artist royalties are included in the quoted price and will not be added as separate charges. Delivery costs are not included in the advertised price and will be calculated and added to your order total separately. We can provide quotations for international deliveries upon request.

Payment can be made using Credit Card, Debit Card, Cheque, or bank transfer. For online purchases, we also accept PayPal. Please note that artwork will only be dispatched once your payment has been confirmed as cleared funds.

Shipping

We are pleased to offer FREE standard shipping on all orders within the UK. For international orders, discounted shipping rates apply. Please contact us for a personalised shipping quotation before placing your order.

We aim to dispatch your artwork promptly and securely. The delivery method used will vary depending on the specific piece. We aim to dispatch most artworks within 24 hours of payment clearance. Please be aware that very large or specialist pieces may require a specialist art courier, which could result in a longer delivery timeframe. We will inform you of this at the time of order or upon request.

Once your artwork has been dispatched, we will send you tracking details where applicable.

If you require delivery on a specific date or have any other delivery-related questions, please do not hesitate to contact us.

Retention of Title

The legal ownership (title) of all artworks purchased from Stephenson’s Gallery Limited will remain with the gallery and will not transfer to the buyer until the full invoice amount has been received and cleared.

Anti-Money Laundering Obligations

In compliance with UK government regulations, specifically the 5th Money Laundering Directive (5MLD), which came into effect on 10th January 2020, Stephenson’s Gallery Limited is required to conduct due diligence on clients purchasing artwork above the threshold of €10,000. This is to mitigate the risk of money laundering within our business.

Therefore, before finalising any sale above this threshold, Stephenson’s Gallery Limited is legally obliged to carry out identification checks on all buyers.

For individual buyers, we will require a clear copy of a valid photographic identity document such as a passport, driving license, or national ID card. This document must clearly show your full name, date of birth, nationality, and permanent residential address.

For corporate buyers, we will require company registration details, including evidence of incorporation, the names of directors, and the details of the ultimate beneficial owners.

If an agent or advisor is acting on behalf of a buyer, we will need to identify both the agent and the ultimate buyer.

Payments to the gallery must be made from a bank account, debit card, or credit card held in the name of the individual or entity named on the invoice and must match the identity documentation provided.

All personal information you provide to us will be handled and processed in accordance with the General Data Protection Regulation (GDPR) and will be always kept secure and confidential.

Website Image Accuracy

Please be aware that due to variations in photographic processes and individual screen settings, Stephenson’s Gallery Limited cannot guarantee that the images of artworks displayed on our website perfectly represent the actual works. We strongly advise customers to view artworks in person at our gallery in York or, by prior arrangement, at a client's home before making a purchase. Governing Law

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of England and Wales.

Delivery

We utilise various shipping methods to ensure the safe delivery of your artwork, depending on the specific piece. We aim to dispatch your order on the next working day. However, please note that short delays may occur if bespoke packaging is required or if the artwork needs to be shipped via a specialist art courier.

Returns and Refunds Policy

Your Rights Under the Consumer Contracts Regulations 2013:

You have the right to cancel your order for any reason within 14 days of receiving the artwork. If you wish to exercise this right, you can request a:

Full refund if you have changed your mind.
Full refund if the artwork arrives damaged.
Exchange for another artwork.

To initiate a return, please email us at contact@stephensonsgallery.co.uk, quoting your order number. We will then provide you with the necessary return instructions.

For all returns, the artwork must be securely repacked in its original packaging for shipment back to us.

If your purchased artwork has not been delivered within 10 days of your order date, please contact us at contact@stephensonsgallery.co.uk.

Upon receiving the returned artwork, we will send you an email confirmation. Refunds will be processed within 7 working days of our receipt of the returned item. The refund will be issued using the same payment method you used for the original purchase.

In the unlikely event that your artwork arrives damaged, you must notify us within 48 hours of delivery, providing details of the damage and photographic evidence if possible.

For returns where you have changed your mind, the cost of returning the artwork to the gallery is your responsibility. We recommend using a tracked and insured postal service as the artwork remains your responsibility until we receive it. Please note that we are unable to refund the original shipping and/or delivery charges, as well as any international customs duties or taxes that may have been applied.

If your artwork is damaged upon arrival, please notify us immediately, providing a detailed description of the damage and including photographs if possible.
